The harsh new NSW road rules you need to know

It could cost you five demerit points. 

From September 17th, New South Wales drivers could cop a $337 fine and lose five demerit points if they’re found with their hands on the mobile phone. The harsher penalties are part of a nationwide crackdown on motorists using mobile devices while on the road.

During double demerit periods, such as long weekend and public holidays, drivers can be penalised up to ten points.

The rules surrounding mobile phones can often be confusing to drivers – so when can you use your phone?

According to Transport NSW, fully-licenced drivers are able to use their phone in the following situations:

  • If the phone is in a secure cradle, drivers are able to make or answer calls, play music, and use the navigation system. You cannot text, email, or use social media.  
  • If the phone is not in a cradle, drivers can use any features that can be actived without being touched, like Bluetooth and voice activation
  • If they are passing the phone to a passenger

Learner, P1 and P2 drivers are only able to use their phone if the vehicle is parked. If they are caught using a phone, Learner and P1 drivers will face an automatic three-month licence suspension, while P2 drivers will lose demerit points.
